As part of the Peach / IMD / Fastrax platform in partnership with Yacast / Muzicenter, the provision of music video(s) to music channels is done digitally without the delivery of physical media.
However, in this case, the provision of each music video is still accompanied by the signing of a document, called the 'specific supply contract,' which acts as a broadcasting authorisation.
A first step has already been taken, eliminating the transmission of this physical document to the channels.
The label uploads the signed and scanned contract when ordering the delivery of the music video; the music channel then downloads the signed contract, prints it, countersigns it, and returns it to the label.
The parties involved are currently implementing the final step, which will allow the digitalisation of this broadcasting authorisation process for music videos by the producer or their representative (most often the music label).
This streamlined system will allow:
- The reduction of errors,
- The reduction of time spent at all stages of the supply and broadcasting authorisation process for music videos,
- The simplification and acceleration of declarative formalities.
The Legal Framework
Each channel has entered into a 'general agreement of common interest' with the Civil Societies (SCPP, SPPF), which defines, among other things, the general conditions for broadcasting music videos by the channel. Historically, this contract includes an appendix, a 'specific music video supply contract,' acting as a broadcasting authorisation and identifying the relevant music video. This contract must be signed by both parties (label and channel) for each music video supplied.
From now on, this 'general agreement of common interest' will provide for new provisions in the event of the digitalised supply of a music video, allowing the formalisation of the digitalisation of the 'specific music video supply contract' acting as a broadcasting authorisation.
New provisions will also be integrated into the terms of service of Yacast / Muzicenter and Peach / IMD / Fastrax, which will provide that:
- The placement of an order for the delivery of a music video by the label in the Yacast / Muzicenter service will constitute authorisation for the broadcasting of the music video by the channels concerned by the delivery order, replacing the signature of the specific supply contract, provided the channel complies with the general access and usage conditions of the service as well as with the music video made available by the label.
- The acknowledgment of receipt of the music video by the channel in the Peach / IMD / Fastrax service will constitute acceptance of this broadcasting authorisation.
How does it work for labels?
The only formality for the label is to accept the updated general terms of service of the Yacast / Muzicenter service, which formalise these legal principles. It is particularly important for the label to ensure that the ISRC number provided accurately corresponds to each music video authorised for broadcasting.
How does it work for music channels?
The channel signs the updated general terms of service for the Peach / IMD / Fastrax service, which reflect these legal principles.
The channel also signs an amendment to the 'general agreement of common interest' with the SCPP and SPPF, formalising the digitalisation of this broadcasting authorisation process and its acceptance by the channel.
How does it work for data flows?
When the channel acknowledges the receipt of music videos in Peach / IMD / Fastrax, this automatically triggers the sending of a data flow to the relevant Civil Society. This data flow contains:
- Data related to the music video: identification of the relevant music video, label, rights holders, ISRC, and other relevant information under the contract (e.g., product placement for payment).
- Data related to the delivery order: reference and timestamp of the delivery order (=broadcasting authorisation).
- Data related to the acknowledgment of receipt: identification of the channel, reference, and timestamp of the acknowledgment (=acceptance of the authorisation).
